VACATION RENTAL TERMS & CONDITIONS
By booking or occupying a property marketed or managed by Luxury Mtn Retreats LLC (“Luxury Mtn Retreats,” “we,” or “us”), the primary renter (“Guest”) agrees to the following Vacation Rental Terms & Conditions (“Policies”). These Policies apply to all occupants, invitees, and visitors of the Property.
These Policies form part of the binding rental agreement and govern Guest conduct, liability, and financial responsibility during and after occupancy of the Property. These Policies apply in addition to, and not in place of, any booking platform terms, confirmation materials, or supplemental agreements provided at booking.
1. DEPOSIT & PAYMENT POLICIES
• 50% of the total rental cost is due at the time of booking.
• The remaining balance is due sixty (60) days prior to arrival and will be automatically charged to the card on file.
• Reservations made within sixty (60) days of arrival require full payment at booking.
• Payment confirmations are automatically issued when charges are processed.
2. CANCELLATION & REFUND POLICIES
• Free cancellation within twenty-four (24) hours of booking for reservations made more than sixty (60) days prior to arrival.
• A $250 per-unit handling fee applies to cancellations made more than sixty (60) days prior to arrival.
• 100% of all rental payments received are non-refundable for cancellations made fifty-nine (59) days or fewer prior to arrival.
• No refunds or prorated refunds are provided for weather conditions, lack of snow, ski conditions, transportation delays, illness, or personal circumstances.
• Guests are strongly encouraged to purchase travel insurance.
• At Luxury Mtn Retreats’s sole discretion, a partial or full refund may be issued only if lost rental nights are successfully re-booked.
• In rare circumstances requiring relocation, Luxury Mtn Retreats may relocate Guest to a property of equal or greater value or cancel the reservation and refund all rental payments received.
• Luxury Mtn Retreats’ maximum liability shall not exceed the total rental fees paid by Guest. No incidental or consequential damages shall be owed.
• No verbal statements, representations, assurances, or communications outside of these Policies shall modify, waive, or expand cancellation or refund eligibility under any circumstances.
3. CHECK-IN & CHECK-OUT
• Check-in: 4:00 PM
• Check-out: 10:00 AM
• Unapproved early check-ins will be charged 50% of one additional night’s rent.
• Unapproved late check-outs will be charged 100% of one additional night’s rent.
• Early check-ins and late check-outs must be approved in writing at least three (3) days in advance.
4. HOUSEKEEPING & CLEANING
• A starter supply of soap, shampoo/conditioner, and body lotion is provided upon arrival.
• These amenities are not replenished during the stay.
• Additional or daily housekeeping is available for an additional fee upon request.
Excess Cleaning
Guest must leave the Property in a reasonably clean condition. Excessive cleaning beyond normal wear and tear will be charged to Guest’s card on file based on actual costs incurred.
5. SPECIAL POLICIES
No Smoking
Smoking of any kind is strictly prohibited. A minimum $750 fee will be charged if smoking is detected. Additional charges may apply if remediation exceeds this amount.
Pets
Pets are not permitted unless the Property is explicitly designated as pet-friendly and prior approval is obtained.
• Unauthorized pets: minimum $500 fee, immediate eviction, no refund.
• Approved dogs only; no cats or other animals.
• Non-refundable pet fee applies.
• Guest is responsible for all pet-related damage and cleaning.
Parking
Parking availability is limited and varies by Property.
• Garage clearances apply.
• 4-wheel drive is strongly recommended and may be required in winter.
• No RVs permitted.
Internet & Wi-Fi
Internet service is provided by local providers. No refunds are issued for outages or service interruptions.
Internet and Wi-Fi service are not conditions of the rental, and temporary or extended service interruptions shall not constitute a breach of the rental agreement or entitle Guest to any refund, credit, or compensation.
Minimum Age
Primary renter must be at least 25 years of age.
Air Conditioning
Unless explicitly stated, Luxury Mtn Retreats properties do not have air conditioning.
6. SHIPPING & DELIVERIES
Guests are strongly discouraged from shipping items to the Property.
If approved shipments are delivered to Luxury Mtn Retreats’ office:
• $100 handling and delivery fee applies for shipments not exceeding four (4) standard checked-bag–style items or two hundred (200) pounds total.
• Larger or heavier shipments will incur a $200 delivery and handling fee.
• Luxury Mtn Retreats is not responsible for lost, delayed, or missing items.
7. LAWS, RULES & HOA COMPLIANCE
Guests must comply with all applicable federal, state, and local laws, HOA rules, and occupancy regulations.
8. NOISE, EVENTS & OCCUPANCY
• No parties or events without prior written approval.
• Violations may result in immediate eviction with no refund.
9. TOWN OF VAIL ORDINANCE COMPLIANCE
For properties located within the Town of Vail:
• Quiet hours: 10:00 PM – 8:00 AM MST
• Excess noise includes any sound audible from another property.
• Violations may result in a $2,500 municipal fine, which will be charged directly to Guest’s card on file.
10. ASSUMPTION OF RISK
Guests assume all risks associated with occupancy, including high-altitude conditions, snow and ice, hot tubs, fireplaces, appliances, utilities, and acts of third parties.
11. LIMITATION OF LIABILITY
Luxury Mtn Retreats’ liability shall never exceed the total rental payments received. Guests waive all claims exceeding this amount.
12. PROPERTY PROTECTION FEE (PPF)
The Property Protection Fee (“PPF”) covers accidental and unintentional damage to the Property or its contents occurring during Guest’s stay, up to a maximum of $1,500, provided all requirements of this Section are met.
Accidental damage includes sudden, unintended incidents that occur during normal use of the Property, including but not limited to:
• Broken or cracked glass, windows, mirrors, or shower enclosures
• Damage to rugs, carpets, or upholstery caused by spills or normal accidents
• Jammed, clogged, or damaged garbage disposals caused by improper but non-malicious use
• Broken fixtures, lamps, furniture, décor, or household items resulting from accidental impact
• Minor appliance damage not caused by misuse, neglect, or intentional acts
Luxury Mtn Retreats acknowledges that such accidents may occur during normal occupancy and does not penalize Guests for accidental damage when properly reported and documented.
All accidental damage must be reported in writing to Luxury Mtn Retreats within forty-eight (48) hours of occurrence or discovery, and in all cases prior to check-out, to be eligible for coverage under the PPF.
Failure to timely report accidental damage in writing, or discovery of damage after departure that was not previously disclosed, shall render the damage ineligible for PPF coverage, and Guest authorizes Luxury Mtn Retreats to charge the full cost of repair or replacement to the card on file.
13. HOT TUB & POOL USE; WATER CONTAMINATION
Where a Property includes a hot tub and/or swimming pool, Guest acknowledges that proper use is required to maintain water safety, sanitation, and rental readiness.
13.1 Guest Use Requirements
Guests are required to comply with the following rules at all times:
• Guests must rinse or shower prior to entering the hot tub or pool to minimize contamination from lotions, oils, sunscreen, cosmetics, or other substances
• No smoking or vaping in or near the hot tub or pool
• No littering in or around the hot tub or pool
• No beverages, food, glass, or other substances of any kind may be introduced into the water
• The hot tub or pool must be covered when not in use to prevent evaporation, contamination, debris, or chemical imbalance
Failure to comply with these rules may result in water contamination, chemical imbalance, or damage to equipment.
13.2 Hot Tub & Pool Service Fees
Any hot tub or pool fee charged with the reservation covers one (1) standard service only, including routine chemical balancing and light maintenance.
If improper use, contamination, or failure to follow the rules above results in the hot tub or pool becoming unserviceable, requiring draining, cleaning, sanitizing, refilling, rebalancing, or additional servicing to restore rental readiness, additional charges will apply as follows:
• Hot Tub: $250 per occurrence
• Swimming Pool: $500 per occurrence
These charges reflect actual labor, chemicals, water usage, service coordination, and loss of rental readiness.
13.3 Authorization to Charge; No Refunds
Guest authorizes Luxury Mtn Retreats LLC to charge the credit card on file for any hot tub or pool remediation fees required due to violation of these Policies.
No refunds, credits, or discounts shall be issued for loss of hot tub or pool use resulting from contamination, service interruptions, or remediation required due to Guest actions or omissions.
13.4 Assumption of Risk
Use of hot tubs and pools is at Guest’s own risk. Guest assumes all risks associated with water use, including injury, illness, chemical sensitivity, and environmental conditions.
14. LAUNDRY FACILITIES; DETERGENT; ASSUMPTION OF RISK
Where a Property includes a washer and/or dryer, such appliances are provided for Guest convenience only.
14.1 Laundry Detergent & Supplies
Due to health, safety, allergy, and liability considerations, Luxury Mtn Retreats LLC does not provide laundry detergent, fabric softener, dryer sheets, or any other laundry-related products.
Any detergent or laundry products found within the Property are not provided, supplied, warranted, or maintained by Luxury Mtn Retreats, and Luxury Mtn Retreats makes no representations regarding their contents, safety, suitability, or condition.
Guest is solely responsible for acquiring and using appropriate laundry products at Guest’s own discretion and risk.
14.2 Washer & Dryer Use; Assumption of Risk
Use of washer and dryer appliances is entirely at Guest’s own risk. Guest assumes all responsibility and liability for any exposure, allergic reaction, damage to personal property, shrinkage, discoloration, mechanical issues, or injury arising from the use or misuse of laundry appliances or products.
Luxury Mtn Retreats LLC shall not be liable for:
• Damage to clothing or personal items
• Allergic reactions or sensitivities
• Mechanical failure during use
• Water damage or overflow caused by misuse
• Loss or damage resulting from unattended operation
14.3 No Warranty or Guarantee
Laundry appliances are provided without warranty of uninterrupted operation or suitability for any particular purpose. No refunds, credits, or compensation shall be issued for inability to use laundry facilities due to malfunction, outage, or Guest misuse.
15. CREDIT CARD AUTHORIZATION
Guest authorizes Luxury Mtn Retreats to charge the credit card on file for all rental charges, fees, fines, damages, penalties, excess cleaning, ordinance violations, and policy breaches incurred during or after the stay, including amounts discovered after departure.
16. DAMAGE, VIOLATION & EVICTION ENFORCEMENT
Violation of these Policies, including noise violations, unauthorized pets, smoking, or occupancy breaches, may result in immediate eviction without refund. Guest remains financially responsible for all damages, fines, and fees incurred.
17. CHARGEBACKS & DISPUTES
If Guest initiates a chargeback or payment dispute for charges properly assessed under these Policies, Guest agrees that up to a $500 chargeback administration fee may be charged to cover costs incurred in defending against fraudulent or improper disputes. This administration fee is separate from and in addition to any underlying charges and reflects actual costs incurred by Luxury Mtn Retreats, including documentation preparation, evidence compilation, administrative processing, payment processor fees, and internal review time.
18. FORCE MAJEURE / EVENTS BEYOND CONTROL
Luxury Mtn Retreats LLC shall not be liable for, and no refunds, credits, discounts, or prorated refunds shall be issued for, any interruption, delay, inconvenience, relocation, or inability to occupy the Property caused by events or circumstances beyond Luxury Mtn Retreats’ reasonable control (“Force Majeure Events”).
Force Majeure Events include, but are not limited to: power outages; utility failures; internet or communication outages; water, sewer, or gas interruptions; severe weather; snowstorms; road closures; wildfires; floods; acts of God; earthquakes; pandemics; epidemics; governmental orders or restrictions; labor disputes; transportation disruptions; mechanical failures not caused by gross negligence; HOA actions; or failures of third-party service providers.
Guest acknowledges that mountain environments and resort communities are particularly susceptible to such events and accepts these risks as part of the rental experience.
In the event a Force Majeure Event renders the Property partially or temporarily unusable, Guest shall not be entitled to any refund, credit, or compensation, and Guest’s sole remedy shall be to rely on any applicable travel insurance coverage.
Luxury Mtn Retreats’ maximum liability for any Force Majeure Event shall not exceed the total rental payments actually received.
19. ACCEPTANCE OF POLICIES
By booking or occupying the Property, Guest acknowledges and agrees to these Vacation Rental Terms & Conditions. Guest acknowledges that these Policies were made available prior to booking and that acceptance was required as a condition of reservation.
20. GOVERNING LAW & VENUE
These Vacation Rental Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict-of-law principles. Any legal action, claim, or proceeding arising out of or relating to these Policies, the booking, or occupancy of the Property shall be brought exclusively in a court of competent jurisdiction located in Eagle County, Colorado.
